Q: I never had to pay sales tax before, why do I have to do it now?

A: As a result of the US Supreme Court ruling in South Dakota v. Wayfair, Inc., et al. (2018) it is legal for states to collect sales tax from companies located in other states. Not all states have opted to do this, yet, and each state has its own set of rules for determining “nexus” (a fancy way of determining what companies must collect and pay sales tax). Q: Do I have to pay sales tax if I buy online?

A: Yes. Because of Nexus Laws (see above) in place by the states, customers must pay sales tax if they are a resident of the following states: 

  • Florida
  • Washington, DC
  • Maryland
  • Massachusetts
  • Oklahoma
  • Vermont
  • New Jersey
  • Washington
  • Georgia
  • Virginia 
  • Pennsylvania
  • Illinois
  • Indiana
  • Kentucky

Q: What if I am tax exempt?

A: If you have a current tax-exempt certificate: Upload your tax-exempt certificate here. Once we receive this, we will adjust your store account and you will not be charged sales tax. We must have your tax-exempt certificate on file BEFORE you make your purchase! If a valid tax-exempt certificate is not on file before you make a purchase – we cannot, and will not, refund taxes on your purchase. In addition, a tax-exempt certificate cannot be applied on any past order(s).

 

Q: If I am tax exempt do you have to refund my tax?

A: No. States give retailers the right to refuse tax-exempt certificates. In these cases, the buyer must keep their invoices and submit them for a tax credit when filing their business taxes.

 

Q: Do I have to send in a tax-exempt certificate before every purchase?

A: No. You must create an account on our website (www.pressuretek.com ) and send us your certificate OR if you have an account send it to us as stated above. We can then set you up as tax exempt. When you want to make a purchase, log-in to your account and you will not be charged sales tax. However, if you purchase as a “guest” we will not be able to refund the tax charged.

 

Q: Do I have to renew my tax-exempt status?

A: Yes, but that varies from state to state. Normally these need to be renewed every 5 years. Check with your states guidelines to be sure.

 

Q: How do I get a tax-exempt certificate?

A: Contact your state's Department of Revenue and request an application for a sales tax certificate of exemption or visit your state’s DOR website for more information.

 

Q: Can I avoid sales tax if I buy from your competitors?

A: No. The US Supreme Court decision regarding online sales tax is not limited to Pressure Tek. If our competitors are following the law, they must either charge sales tax or, in some states, report your purchase(s) to the Department of Revenue so the state can assess a “usage tax” on your purchase(s) at the end of the year.
